SpiceJet pilots filed written reports about reliability of radar in VT-SLH- which flew straight into a thunderstorm in Durgapur on 1 May injuring 17 people "Radar was not showing extent of actual weather," the captain who flew on 30 April wrote

A maintenance engineer in Mumbai
informed the Maintenance Control Centre
(MCC) about the snag. The engineer was
told that they were aware about the
reliability issue and that there was a
shortage of high-cost spares like weather
radar, according to the draft report.
As per instruction from the MCC, he then
carried out an operational check and
found the weather radar patterns
satisfactory and informed the MCC to
monitor the aircraft further, the report
added.

“In situations where an aircraft is involved
in serious incidents, the MCC and flight
safety department are required to take
permission from the DGCA. However, the
aircraft in the said case was released by
the MCC without consultation with the
regulator in violation of the Aircraft
Accident Investigation Rules, 2017,” the
report said, adding that the chief of flight
safety failed in her duty which included
reviewing and evaluating the emergency
response plan in case of an emergency.

Isn’t it a criminal offence punishable under Indian penal code & the aircraft act !:- 1 jeopardising safety of 100s of passengers !? 2. Violations of air safety rules & 3. False declaration & certification for Release or aircraft 4. Cheating the pilot in command & passengers

Investigation into the incident was handed over to the AAIB, as it was classified as an accident due to passengers sustaining serious injuries. Out of the 14 passengers and three cabin crew who sustained injuries, two had severe injuries to their spine and shoulder and had been admitted to ICU. A preliminary report was submitted within 30 days of the incident to examine the scope of investigation and seek the necessary budget.
